MONITORDAY.COM - Pemerintah diminta mengambil sikap atas deklarasi pemerintahan sementara di Papua Barat yang dilakukan pimpinan separatis Gerakan Persatuan Pembebasan untuk Papua Barat (ULMWP) Benny Wenda.
"Negara harus bertindak tegas," kata Ketua Majelis Permusyawaratan Rakyat (MPR) RI Bambang Soesatyo di Kantor Kemenko Polhukam, Jakarta, Kamis (3/12/2020).
Terkait deklarasi kemerdekaan Papua Barat oleh Benny Wenda, Bamsoet sapaan akrab Bambang Soesatyo, mengingatkan pemerintah tentang konstitusi.

Menurutnya, tindakan Benny yang notabene warga negara asing yang mengklaim dan mengangkat dirinya sebagai presiden sementara di Papua Barat sangat mengganggu konstitusi.
"Dari sudut pandang kami sebagai penjaga konstitusi sangat mengganggu," ujarnya.
"Bukan soal Benny Wendanya, tapi orang-orang atau suasana, situasi politik yang ada di Papua maupun di seluruh Tanah Air," tambahnya.
Menurut Bamsoet, deklarasi pembentukan pemerintah negara Papua Barat bersifat sepihak dan tidak sesuai dengan hukum internasional, termasuk juga peraturan konstitusi dan UU Indonesia sebagai kedaulatan yang sah atas Papua.
Dengan demikian, kata dia, tindakan Benny Wenda adalah pengikaran terhadap amanat konstitusi.
"Bahwa menurut Pasal 106 KUHP makar dengan masuk sebagian wilayah negara jatuh ke tanah musuh atau memisahkan sebagian dari wilayah negara diancam dengan pidana seumur hidup atau pidana penjara sementara selama-lamanya 20 tahun," tuturnya.
"Maka sesungguhnya apa yang dilakukan UMLWP dengan mendeklarasikan negara dan menjadikan Benny Wenda sebagai presiden Papua Barat sudah sangat jelas merupakan perbuatan makar terhadap Negara Kesatuan Republik Indonesia," tukasnya.[]
